who's right & who's wrong ... and who's really wrong

Was in my car at a stop light, a taxi pulled up next to me and as usual he went right up past the
line where cars should stop ... so he was a little ahead of me in the next lane ...

The road had a very slight incline ... enough so that if a car was in N, it would roll backwards ...

A private car pulls behind the taxi ... the taxi driver was counting his money when his taxi rolled back and hit the car behind him.
He jumps out and starts shouting at the guy in the private car why he hit him ... lots of 'delay no more' stuff ...
they argue and of course the cab guy thinks he who shouts loudest wins the arguement ...
(I, being the kind of person with no life, pulled my car to the side of the road to continue watching)
both goes on their cell phone ... 10 mins later 1 cab pulls over and a few mins after that another cab pulls up ...
the 3 then started to tell the private car guy how no one will believe his story and he was the one who will be in wrong
(I'm using nice words here)
5 mins after that, 2 bike cops enters the scene ... immediately the cabbie tells them his neck hurts and he might need an ambulance ...
Since the actual damage to both cars were slight and the cops was telling both sides to settle themselves ...

No deal ... it just wasn't going to happen ... not from someone who's thinking he could get away with this scott free
and maybe make something on top of it as well !!!

My question is ... in the absence of any witnesses, who will be deemed wrong under these circumstances ?
(note that HK driving law emphasizes the car behind has more duty of care then the car in front)

No ambulance arrived so I presume it was not called.

At this point I had to do my civic duty ... walked up to one of the cops and told him details of what I saw ...
after taking down my details he turned round and pointing his finger at the cabbie thlling him he might be charged
with wasting a policeman's time unless things gets sorted out immediately ... and finally ended with the cabbie paying 1K
to the private car driver and I left with a lot of thanks from him !

Sounds same as law in OZ, no witness then car behind is always deemed at fault. However cab was in wrong and just ethical to be good citizen and willing to be witness.  

I had cab in front of me heading north, turning right on green arrow late one night and civilian came through heading south after his light was red for some time. He hit cab real hard in rear passenger side and spun cab into pole. Cabbie was in shock, he took quite a hit, and civi was trying on BS the cab turned illegally across intersection.

I didn't wait around but told both of them I saw civi run light and would be witness for cabbie, made sure civi saw me give cabbie my business card. Only 5 minutes of my time but arseholes need to know some one will speak up to truth.

If no witness the Cabbie will get off Scott free but thanks to you the right person was did right this time.

I have a experience like that I was the one that was wrong and the cop was on my side due to evidence.

Here is what happen. I was cut off but a car on the highway( DVP ) in Toronto. I had to move over the the other lane to avoid hitting the him, i was driving a truck when i enter the other lane almost hit the car was in that lane and when i caught up with the car i signal to the driver to watch what he was doing. Well i return the passenger in the car flip me the bird and throw a apple at me. Now i was full of rage and i empty a big bottle on water on the car. They throw more stuff at me and then start driving in front of me. As traffic slow down in front of them, he slow down but i push the gas harder and slam into him at about 80km. I move my truck to the shoulder lane i notice there was no damage to the car but just a scratch on the bumper. No one exit the car fearing for they life and was on the cell calling 911 saying i was trying too kill them. The cops show up within 5mins and was ready to kill me. When i was waiting me and my passenger work out our story, change the story a bit. I told the cops lead up to the whole thing but that last part of it. I change it from me slamming into the car by tell the cop, he pull in front of me ad slam on his brakes and since i am in a truck it takes longer to stop and there is only a scratch  on his bumper and ask him who he is going to believe. So the other driver got a ticket for careless driving.

thats very honourable of you. taxi drivers are suck wankers in hong kong sometimes, cutting people up without indicating. pisses me off!

I think you did a honorable thing for being a witness to the accident. The cab driver is clearly wrong and they are in huge numbers in HK.
In the states this would be rear-end accident and the fault falls to the unlucky guy or the private guy hitting the cab driver. Unless there was
a witness that stands up to this like you did. I think it would be hard to prove in court.

You said it right. He started it and i just happen to finish it to teach him a lesson. I was nice about it in the beginning. What they did was uncalled for and what it did was wrong...... And road rage took over from there.

Not gonna give A either + or - ... but your story's an interesting one.  Appreciate you sharing it so candidly and without excuses.  

In think if we're honest we can all admit to having plenty of road-rage moments, I certainly do even if I never actually reached the point of physical retaliation (yet).  

BTW did you watch the BMW city-boy vs rednecks movie?  It's an absolute classic ... I watch it every time I want to experience a revenge fantasy:-

On the flip side I saw an FML recently about a guy who got angry at a car tailgating him and flashing him, who slowed down and blocked the car for as long as he could ... and then when it finally managed to pass he saw it was a guy taking his wife to hospital in labour ... justgoes to show not all bad behaviour is intentionally inconsiderate.  

But 2aw's taxi driver is a jerk and got what he deserved.  Will defo bear it in mind as I drive around ...

Yeah, I know he started it but there's a huge difference between somebody giving you the finger and you ramming his car with your truck at 80k. A slight over-reaction I'd say.   Not to mention that they might have got out and beaten the crap out of you.
