SELLING SEX FOR MONEY is legal
but anyone doing any work in Hong Kong without a Work Visa or Residence Permit - paid or unpaid - faces a possible jail term.
Most of the girls working in their own appartment - aka walkup aka 141 - are locals and are totally legal (from their point of view).
But the Immigration Department only issues a Work Visa to a foreigner if a) an employer will sponsor the application and b) there is reasonable proof that a local is unable to provide the same services. Even if b) is the case - i.e. a girl who can actually offer something a local girl can't - she would fall foul of the prostitution laws as a result of a) because she cannot (legally) have an employer or agent for doing sex work and therefore cannot have a sponsor. So she can't get a work visa for sex work.
This is why if you look around you'll find some girls who come to Hong Kong don't trouble to get a work visa ... hoping to make a quick buck off a quick fuck without getting caught ...
