Hong Kong wife wins US$154 million divorce settlement

Hong Kong (CNN) -- A Hong Kong judge ordered a wealthy real estate mogul to pay his former wife $154 million in one of the city's largest divorce settlements.

The divorce award translates to HK $1.2 billion and dwarfs famous settlements in other countries.

In comparison, Paul McCartney was ordered to pay Heather Mills almost $50 million three years ago.

Court documents released Thursday detailed a breakdown of the ruling.

It includes a home in the city worth HK $250 million, a London residence valued at HK $30.5 million and HK $2.5 million to buy two cars.

Samathur Li Kin-kan and his wife, Florence Tsang Chiu-wing, married in 2000 and separated in 2008, according to court documents.

They lived a lifestyle "best described as just below that of a US- dollar billionaire," court documents said.

The wife told local media she was "delighted" as she left the courtroom smiling.

Those 8 years must have been the best years she ever had. Lived the life of the rich and famous only to divorce to continue to live the life of the rich and famous without the presence of her husband. What kind of Judge in their right mind would award such a settlement??

Sorry - but Hong Kong laws do NOT specify 50-50. Are you perhaps thinking of No-fault states in the U.S. like California?

Hong Kong laws are based upon English common law and divorce laws are unfortunately the product of the English circumstances.

Common law states that the wife and children should be provided for BY THE HUSBAND after divorce in the same standard of living they enjoy whilst married - and this is based upon the rationale that if the husband does NOT provide this standard of living, that the STATE will be the one on the hook.  Thus this particular evolution of the Divorce laws of the UK...and now Hong Kong.

What Common law also did NOT account for (in the over-riding need to protect the STATE against having to provide welfare etc to a divorced woman/family) are cases like the above where the "Law" OVER-PROVIDES for the wife. What - she can forego her "wifely duties" and the husband is legislated to still carry out his duties? Never mind that she was a solicitor herself - she is now NOT compulsed to ALSO contribute to the up-keep/well being of herself and the child>?

The Hong Kong laws really screw the husbands...without him getting his screwing!!

Hong Kong law is indeed based on common law

but I'm told it was modified by statute, not so long ago, to provide for a more even distribution of assets in the case of a divorce

clearly - since in this case she only got about 1/4 - the 50/50 rule must have some provisos
but it's certainly not a surprise that Hong Kong has set a new record for divorce settlements

They deserve some money to live and get by but I see no reason for them to continue living the lifestyle of the rich and famous after they divorce you. If you live with a very rich person and are married to that person then you should be entitled to live rich like him but if either one divorces the other then that other party lost out. Imagine leasing a Porsche and when the lease is up the Porsche goes back to the dealership and the dealership asks you to continue to make payments on the Porsche

all very well,

but while you're using the Porsche, you're not just paying running costs

you're also paying (fully loaded and pessimistic) depreciation costs
AND a healthy profit to the leasing company
so by the time the lease is up you've paid a lot more than you would have with outright long-term ownership

... and we all know what happens when there's an early termination of a leasing contract

Which all means
If you're wealthier than she is, use a pre-nup
If she's wealthier than you are, don't
