if you are caught having sex with a minor u will not only get a court fine and community service you will also have a RECORD. thats the bad thing. having a record follows you for life it does not get removed. if you are caught a 2nd time you potentially will have to go play "pick up the soap" for a few months. This is not a guess this is a fact. so if you think the WG is abit young ask to look at her passport/ ID card. as for punting it is totally legal as long as you are in a room with only one WG. anymore than one its illegal.

WG can advertise their business BUT they are not allowed to walk the streets to muster up business. I was told that they could in reality shout down from their windows BUT they cannot go on the street to pull punters, something to do with the history of the law, please dont quote me on this one as I am not 100% sure but i have heard of this from many informed historians haha.

so all in, its not illegal to have sex in a room with one other person who is not a minor. it's troublesome if one is caught in a cleanup raid but it isnt illegal and as long as you do what the police ask you have no problem. even if the girl is entering HK illegally or on a tourist visa and you are caught having sex with her you have no legal problems just alot of hassle AND the police have to let you go cause there is no case against you, however you may be asked to go to the police station to help in the investigation.

Most of this information was told to me by a high level lawyer friend of mine HOWEVER the information is more than 10 years ago BUT i do not think the law has changed at all regarding this matter.

just to inform all brothers GFS maybe at risk since nearly all the reports on the sauna section has been related to GFS. what is happening in GFS is illegal. best to keep reports down regarding the place for the time being.

I'm not a lawyer but this info comes from my ex-police source.  He claims to have been present on similar raids in the past, which is why he is very reluctant to punt in Hong Kong.  According to him, the greatest embarrassment (and his greatest fear) is if the people hauled in plead not guilty and choose to go to a trial.  This does not usually happen, and those charged usually say yes, fair cop, pay the fine or get deported or whatever and start again.  

If however they plead not-guilty, then you the punter will become witness for the prosecution, and may have to appear in open court to give evidence (Smile - you're on candid camera).

It might also be a bit embarrassing if you have a close relationship with your agent to have to give evidence against him/her, with all the implications that invovles - I'm sure the agents all have mean friends.

My problem is with this part :

so that's why I hope someone with legal knowledge of HK will step forward and clarify
what rights we as a punter have in these situations

In any case, in HK a person still has the 'right to silence' so if you don't want to answer police questions, you don't have to (there are exceptions such as producing your ID card).

But the thing is, all this will just create a lot more hassle and time. If all you want to do is get out of there asap (I think most people do), then usually, the easiest thing you can do is to cooperate with the police especially if you have done nothing wrong.

Now if you have done something wrong, e.g. underage, then you will probably want to speak to a lawyer and have one present before you answer anything.

A handwritten sign advertising the prices for various nationalities of women outside a brothel on Soy Street in KowloonProstitution in Hong Kong is legal, but subject to various restrictions, mainly intended to keep it away from the public eye.[4] These restrictions are manifested in the form of prohibiting a whole host of activities surrounding prostitution, including soliciting and advertising for sex, working as pimps, running brothels and organized prostitution. For instance, by the Hong Kong legal code Chapter 200 Section 147, any person who "solicits for any immoral purpose" in a public place may receive a maximum penalty of HK$ 10,000 and six months' imprisonment. In practice, a woman on the street in certain areas well-known for streetwalkers such as Sham Shui Po might well be arrested even if seen smiling at a male passerby.[4] Advertisement of sex services, including signboards, illuminated signs and posters, is also prohibited, and an offence may result in imprisonment for 12 months.[14]

Organized prostitution, in the form of directing "over another person for the purpose of... that person's prostitution", is forbidden by Section 130, and an offence may result in 14 years of imprisonment.[15] Sections 131 and 137, which are aimed at pimps, stipulate a jail sentence of seven years as the maximum penalty for "procuring another person to become a prostitute" and "living on earnings of prostitution of others".[16] Under Hong Kong law, it is also illegal to organize arrangement of sex deals for more than one woman; violators are subject to a HK$20,000 fine and seven years' imprisonment.[8] Therefore, if two women are found serving customers in the same apartment, it is an illegal brothel. This gives rise to the so-called "one-woman brothel" where one woman receives customers in her apartment, which is restricted by Section 141, which prohibits young persons to engage in prostitution.[17] This is the most common form of legal prostitution in Hong Kong.[9]

Strategies to avoid the prohibition on brothels
Brothels are illegal, prostitution in private however is legal. To avoid this prohibition, in practice much of the prostitution is controlled by triad societies or as informal additions to otherwise nonsexual services such as massage parlors, bars and karaoke establishments. Among the many forms of prostitution common in Hong Kong are "one for one" girls. To avoid the operation of an illegal brothel, triads will rent tiny apartments and allow girls to "sublet" them so they appear to be operating out of their own homes[citation needed]. The triads then advertise the girls' services on web sites or in local publications[citation needed]. Another avoidance strategy is to operate a karaoke establishment and provide girls as entertainment or companionship only; the girls then take customers to an hourly hotel in the same building and pay for the room separately. Informal, individual prostitution (mostly of Filipinas, Indonesians, Thais, and sometimes women from Latin America and the former Soviet Union) is almost always available at discos or hotel bars, especially in the Tsim Sha Tsui and Wan Chai districts (the latter famous as the setting for The World of Suzie Wong. Occasionally the police raid the triad-run prostitution setups, but usually the only arrests made are for immigration violations. Women frequently enter Hong Kong from mainland China for prostitution services. However, this travel is not forcible; most women working as prostitutes in Hong Kong are of age and are doing so voluntarily[citation needed].

The law and what actually gets practiced in real life are completely different things.  twiceAweek, my advice is to forget about all the legal mumbo jumbo, and just cooperate with the police in these situations.  Less pain less hassle, put up a fight and they'll really make life hard on you.  

HK Police tend to push the limits on everything, since the handover I've notice alot of complaints about police just get shot down, that's because the commission that investigates them is also the same organization: The Police!  Just lately in the news this cop got off for shooting a Nepalese man in the head, that was total bull shit!  He had a shit load of options but choose to shoot the guy in the head!  And the records on this cop was presented to the courts, showed that he was reprimanded a few times for overreacting or pulling out his gun too soon, same was seen on his training records too.  And what happens?  He gets off scott free!

You give the cops trouble and they'll try their best to build a case against you and send that up to court.  The whole process starts with the police, they build the case for the courts.  Even if the courts favor you, you still risk getting in deep shit.  In my mind just too much to lose.

actually ... I know some people that gave evidence in that case and all of them tells me that in this incident the cop
in question was correct in what he did ... is should have been an open and shut case but for the people raising
the race issue.

Anyway back to my point, I'm not saying not to cooperate but to what extent ... thats why I'm going on about
knowing our rights in these situations. In my experience a few years ago I stood my ground with them - I need to find
that post I made, it was in someone else's thread and I just can't remember which one !
