Your anti american sentiment is really amusing.
I will take the time to educate your ignorance on the matter as you seem to be mixing up terms (perhaps something is lost in translation)
Unlock refers to the phones ability to accept a SIM card from using a compatible technology (most of the world uses GSM, though some pockets of CDMA still exist).
Jailbreak refers to an iPhones ability to run unsigned code. (many people incorrectly talk about jailbreaking an android device, it is actually known as rooting, not jailbreaking).
Now to continue with this iPhone discourse... and assuming you are referring to an unlocked phone rather than a jailbroken phone...
To tell if a phone is jailbroken, you must look for a program called cydia. If cydia is present, the phone is jailbroken.
If the phone is NOT jailbroken, you can proceed to step (HU). If the phone IS jailbroken, you can proceed to (SU)
(HU) To tell if the phone is HARDWARE unlocked, remove the SIM tray (it holds the SIM). Place another SIM in the phone. Restart the phone. If you can make a phone call using a different sim, you are hardware unlocked, congrats!
*** There is something called a GEVEY SIM Interposer which requires CYDIA and some other procedures to work, which is why we remove the SIM from the phone and restart it as it messes with the interposer.
(SU) If Cydia is present, it is possible that you have a software unlock. There are two things we will look for, one is very conclusive and a bit difficult for novices. The other is not very conclusive but very easy to do. If you are a NOVICE proceed to (NSU) if (NSU) was not definitive, proceed to (ESU).
(NSU) - Open the settings app.
Scroll down and click on "general"
Click on About.
Scroll down to Modem Firmware. Look for the following numbers:
iPhone 3 3GS - 4.26.08 5.11.07 5.12.01 5.13.04 ***6.15.00
iPhone 4 - 1.59.00
If you see one of these numbers, you MAY have a software unlock proceed to (ESU). if you do not see one of these numbers. You have a hardware unlock (or possibly the most valuable iPhone on the planet....)
(ESU) Open the Cydia app
On the bottom bar, press the "Manage" tab
Then press the "Packages" button
Scroll down and look for something called "Ultrasn0w"
if Ultrasn0w is present, you have a software unlocked iPhone. Be careful because if you update it, you just lost your unlock!
The more you know, (brought to you by someone with an American Passport)!
