Am of course NOT a lawyer and thus cannot give a definitive opinion - but I've studied up on the topic as it IS a topic of self-interest to me!
Prostitution per se is NOT illegal under British common laws, (which Hong Kong is still under) and a woman can chose whatever she choses to do with her own body. The illegal part is "soliciting for the purpose of an immoral act" and "living off the proceeds of prostitution" which covers pimping. OTH though, there have also been attempts by the authorities to use this provision in the law books for it to cover a variety of other situations - even renting out rooms to prostitutes to work out of; but the authorities must be able to prove a DIRECT correlation between the actual earnings of the prostitute and the income so derived. So "an each time levy" as an example is one such correlation versus just generally renting out the premises.
As for the Gals themselves that does this, as long as they do NOT operate in tandem with other girls - where then they would be deemed to be operating a house of prostitution - then it is generally OK. And thus the term one room one phoenix (141) for the walk-up gals - who are usually HK Identity card holder/resident of Hong Kong - and thus fully entitled to do any business she wants to do.
And even the hotel gals, if the room gets raided, even with a punter in it and even when they can prove that she is a prostitute, then the law SHOULD NOT be broken as she is just a prostitute. They will though usually get these girls on other violations like overstaying their time permitted in Hong Kong - an immigration law violation, and/or other laws that they could muster up. The client though is for the most part "safe" as they've not actually broken any laws.
Like I said, am not a lawyer and would appreciate any one else who does have the legal expertise if they would chime in.
